Copyrights Notification Guidelines

ESLeschool respects third parties’ copyrights, and it is our policy to respond to all notifications about copyright infringement as established by applicable law. Once a notification complying with these Guidelines is received, ESLeschool may remove or disable access to the allegedly infringing material, or take such further action as at our discretion may be appropriate.

Copyright infringement notifications must include the following:

• The electronic or physical signature of the person submitting the notification.
• Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
• Identification of the material that is claimed to be infringing and that is to be removed or to which access is to be disabled, and information reasonably sufficient to allow ESLeschool to locate that material on our website.
• Information sufficient to allow ESLeschool to contact the complaining party, such as a name, address, telephone number, and, if available, an email address.
• A statement that the complaining party has a good-faith belief that use of the material is not authorised by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate and true.

If any of the above is not provided, the copyright infringement notification might not be valid.

How we handle a valid notification

ESLeschool will follow the procedures provided by applicable law to ensure compliance with copyright. When a proper notification complying with the conditions above is received, ESLeschool will remove or disable access to the material identified as infringing as soon as reasonably possible. ESLeschool will not necessarily send a confirmation regarding the removal or disabling. We may also notify the person who posted the material that it has been removed or disabled.

Please note that you may be liable if material you identify does not in fact infringe a third party’s rights, or if you knowingly misrepresent that material is infringing. If you are unsure, we recommend that you seek legal advice.

Counter-Notification

If you posted material that has been removed or disabled and you believe this was a mistake or a misidentification, you may submit a counter-notification including the following:

• Your electronic or physical signature.
• Identification of the material that has been removed or to which access has been disabled, and the location at which it appeared before it was removed or disabled.
• A statement that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
• A statement that the information in your counter-notification is accurate and true.
• Your name, address, and telephone number, and, if available, an email address.

On receiving a valid counter-notification, ESLeschool may, at its discretion and in accordance with applicable law, restore the material or notify the original complaining party. ESLeschool is not obliged to restore material and may decline to do so where it considers it appropriate.

Repeat Infringers

ESLeschool may, in appropriate circumstances and at our discretion, limit, suspend, or terminate access to the Service or to any account held by a user who is found to be a repeat infringer of copyright.
